During “Freedom Week,” buyers could purchase ammunition without background checks and order from out-of-state sellers. Although this ended on February 5th,  here is a brief update on the recent developments regarding California’s ammunition laws:

• Federal judges in the 9th Circuit issued a stay on a lower court ruling, reinstating the state’s requirement for background checks with every ammunition purchase and prohibiting direct shipping of ammunition from other states.
• California Attorney General Rob Bonta reaffirmed the state’s commitment to defending its ammunition laws.
• Federal district judge Roger Benitez’s injunction against the bullet background checks and importation rules was cited for violating the Second Amendment and federal commerce clause.
• The 9th Circuit panel voted 2-1 to place a stay on the injunction.

We are uncertain about the case’s status and its future proceedings. However, we strongly believe that the law is unconstitutional. The merits panel may dissolve the Stay, as in the SB2 Restricted Areas, or it may remain in force. It could be sent to the En Banc Panel or reviewed by the 9th Circuit. Only time will tell.

 

Nevertheless, we urge you to join SDCGO, Support FPC, 2nd A Foundation, and CRPA to fight against these unconstitutional laws. Since 2016, we have been battling this law and now have a significant advantage to make a real difference in how Gun Laws are passed in California.
